iBest.net, LLC Best.net Email Policy
iBest.net has a strict Zero Tolerance spam policy. Client server access will be immediately terminated if they send unsolicited email messages. Please report any suspected abuse to abuse@iBest.net. ISPs and blacklists administrators may also contact us at abuse@iBest.net. Please forward the complete email in question, including headers. If applicable, please also unsubscribe from the newsletter using the link at the bottom of the email if you no longer wish to receive emails from that sender. We will take the appropriate action against the sender of the email in question.
For iBest.net Clients
Each iBest.net Client accepts the terms of this policy by using the Services. As part of its agreement, each Client must agree to only send permission-based emails. “Permission-based” (Opt-in) means that all Recipients must have opted-in to receive communications from that Client. For new emails added to a list from a web form, we strongly recommend a double Opt-in methodology be adopted.
An Opt-in can occur either via a sign-up form on a web site, at a point-of-sale sign-up form, or on a physical sign-up sheet. Any Opt-in form should include a clear description of what will be sent and how often it will be sent. Purchased lists may not be used within the iBest.net system, regardless of the source or permission status.
As a Client of iBest.net, you may not:
· Send email to any Recipient who has not specifically asked to receive email from you
· Harvest emails from any web site
· Install purchased lists (whether they are Opt-in or not)
· Have a subscription form that subscribes users to an unrelated list
· Add an email address into a list without the Subscriber’s explicit permission
· Email a Recipient who has requested to be removed from your list except to confirm the removal
· Utilize a list inactive for more than 6 months without reconfirming the Recipients’ subscriptions
You may:
· Send a regular newsletter to a Recipient who has Opted-in to receive it
· Send information and content to Recipients who have requested to receive content on that topic from your organization
Opt-Out
Every outbound message must contain a working one-click Opt-out mechanism clearly visible within the email. List removal may be verified on the Opt-out confirmation page or by sending one additional email confirming the Recipient has been removed from the list.
Social Media Logins
Many sites offer a simplified login method using Facebook, Google+, Twitter and other social networks. Under no circumstances will this login process be considered permission to send email. The Recipient must still specifically Opt-in to receiving email using a double Opt-in method.
Policy Enforcement
iBest.net has a zero tolerance spam policy. By using our mail service, you understand our policy and agree to abide by it in the strictest of terms.
Any Client who is practicing what we consider spamming will lose server access (web, incoming and outgoing email, ftp and any control panel in use) without notice.
After a violation, an account will be permitted one reinstatement. Prior to reinstatement, the account must show proof their entire list has been re-validated by opting-in each email address on their list. Client agrees to pay a $200 reinstatement fee prior to server access being returned to Client. If Client elects not to reinstate service, any unused hosting fees will not be returned.
A second violation will result in the client being removed from the server. Any expenses incurred in correcting problems resulting from the second spam attack is billable and client agrees to pay these charges. Any unused hosting fees will not be returned but would be applied to expenses as outlined above
Blacklist procedure
Client understands sending unsolicited bulk email can cause the iBest.net mail server to be blacklisted, affecting the ability of all other accounts to send email. Should this occur due to Client’s failure to adhere to iBest.net policy, Client understands and agrees to pay a $100 per hour penalty for each hour the server appears on any commonly used blacklist. iBest.net must work diligently to remove our server from various blacklists which can take several hours to several days, depending on the level of penetration within blacklists.
Procedure for Handling Subpoenas
To request from iBest.net information about an iBest.net Client in connection with a civil case, you must serve iBest.net with a subpoena or court order that is valid and enforceable under North Carolina law, and must agree to iBest.net’s terms of compensation set forth herein. All civil subpoenas should be directed to the iBest.net Legal Department. Generally, iBest.net will not produce any information until approximately 30 days after its receipt of a valid subpoena or court order, unless a formal objection is filed by you or iBest.net is legally required to do so. iBest.net charges $200.00 per hour for research (plus additional fees if testimony or deposition is required), $0.35 per page and $22.00 to respond via certified carrier.
